GENERAL TERMS AND CONDITIONS OF
ALPSTAY APARTMENTS
1. SCOPE OF APPLICATION & CONTRACTUAL PARTNERS
(1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for the rental of apartments for accommodation concluded between Alpstay Apartments and third parties (guests), as well as for all other services and deliveries provided by Alpstay Apartments. (Accommodation contract)
(2) The contractual partner of the guest in Austria is Alpstay Apartments or Daniela Danzinger.
2. RESERVATIONS
(1) After the reservation and by paying a deposit of at least 50% of the booking, the guest offers to conclude an accommodation contract. If the booked apartment is available, the guest will receive a booking confirmation from Alpstay Apartments. This confirmation constitutes a contract for accommodation between Alpstay Apartments and the guest.
(2) Offers from Alpstay Apartments regarding available apartments are subject to change and are non-binding. Alpstay Apartments or Daniela Danzinger may, at its sole discretion, refuse to conclude an accommodation contract. (3) There is no entitlement to use the overnight accommodation service in a specific apartment. Alpstay Apartments or Daniela Danzinger reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees, or deposits for certain dates.
3. CANCELLATION DEADLINES/NON-USE OF SERVICES (NO SHOW)
(1) A guaranteed reservation exists when the guest's deposit payment has been received. A guaranteed reservation can be cancelled free of charge by the guest in accordance with the specified cancellation conditions, providing the reservation number. After the expiration of the cancellation deadlines, cancellation is excluded, and Alpstay Apartments retains the right to the agreed compensation minus any saved expenses. The same applies in case of the guest's non-appearance (No Show).
(2) Cancellations must be made in writing by email. In the event of cancellation, the guest is obliged to compensate the accommodation provider for any damages incurred. The following amounts are applicable in case of cancellation:
(3) The landlord reserves the right to cancel bookings at any time. (4) For reservations made on the day before or on the day of arrival, the guest must make payment for the stay immediately, usually within one hour.
4. ACCOMMODATION PRICES & OTHER PRICES
(1) The prices valid at the time of contract conclusion as indicated by Alpstay Apartments apply. The applicable and indicated prices are gross and include all statutory taxes, fees, and charges. Local taxes owed by the guest, such as tourist taxes, are included in the final payment as well.
5. PAYMENT TERMS & INVOICE
(1) The price for the guest's booked night is always to be paid in advance by the guest.
(2) Accepted payment methods are CreditCard or regular bank transfer. Cash payment is not accepted.
(3) For subsequently incurred fees due to additional services used or violations of the General Terms and Conditions, Alpstay Apartments reserves the right to charge the provided payment methods for the outstanding amounts.
(4) With a reservation, the guest agrees to receive the invoice as a download or via email. If the guest still wishes for postal delivery, it may result in an extended delivery time due to organizational reasons.
6. USE OF RESERVED APARTMENTS
(1) A reserved apartment is available to the guest from 4:00 p.m. on the day of arrival until 10:00 a.m. on the day of departure.
(2) Unless otherwise agreed, the keys provided shall be returned to the key boxes on the agreed departure day so that the code is no longer readable.
(3) If a key handed over is lost or not returned upon departure, a fee of 80€ will be charged. The landlord is entitled to demand compensation from the guest for any damage incurred thereby, to the extent that it exceeds the amount of 80€. This includes the costs for the replacement of the affected locking system if necessary for security reasons.
(4) Upon request and subject to availability, an earlier arrival (Early Check-In) can be arranged in advance with Alpstay Apartments. If the landlord agrees to an Early Check-In, they are entitled to charge €10.00 per hour for the additional use of the apartment. There is no contractual entitlement to an Early Check-In.
(5) Upon request and subject to availability, a later departure (Late Check-Out) can be arranged in advance with Alpstay Apartments. If the landlord agrees to a Late Check-Out, they are entitled to charge €10.00 per hour for the additional use of the apartment. There is no contractual entitlement to a later departure.
7. RESALE & TRANSFER
(1) The resale/rental and/or transfer of booked apartments is prohibited. In particular, the resale of apartments and/or apartment contingents to third parties at prices higher than the actual apartment prices is not permitted. In these cases, the landlord is entitled to cancel the booking, especially if the guest has made untrue statements to the third party regarding the nature of the booking or payment.
(2) The use of the apartment for a purpose other than accommodation, especially any commercial or illegal use by the guest, is expressly prohibited. Without explicit consent, the use of the apartments for photo or video recordings is also prohibited. In the event of use for reasons other than accommodation, Alpstay Apartments reserves the right to cancel the reservation without refunds and to vacate the rental property.
